Michigan Shoe Market Exhibitor Contract/Agreement /Liability Clause
Please read carefully the below contract/agreement before registering for the Michigan Shoe Market. All exhibitors must agree to all terms and conditions outlined in this contract/agreement.
Cancellation: No Michigan Shoe Market Market fees paid (including ad space ordered and equipment ordered) will be refundable after the Market registration deadline date.
Shipping & Receiving: Packages sent to the Michigan Shoe Market must be addressed as follows: Name of Exhibitor - Booth # or Room, #, c/o Michigan Shoe Market, Embassy Suites Hotel TROY, 850 Tower Drive, Troy, MI 48098
All packages received by the hotel will be charged a delivery fee based on the guidelines below:
Packages less than 10lbs, $2.00 per box
Packages 10lbs to 35lbs, $5.00 per box
Packages 35lbs to 50lbs, $10.00 per box
Packages 50lbs +, $15.00 per box plus one dollar for every pound over 50 pounds
Packages will be be available for pick up by 4pm Saturday.
For outgoing shipments, packages must be brought to the Hotel Sales Office/Front Desk for pick-up by the shipping carrier. Exhibitors must call FedEx/UPS to schedule a pick-up from the hotel and provide their own shipping label. Embassy Suites Livonia is not responsible for packages not shipped out. The Hotel will accept domestic and international packages up to 2 days preceding each show (the Thursday before the Market is the first day packages can be received by the Hotel) , Packages arriving earlier than 2 days (before Thursday) will be subject to a $25 per package/per day storage fee. The Hotel will accept packages weighing less than 100 lbs. Packages in excess of 100 lbs. will be subject to a $25 special handling fee. The Hotel will NOT accept packages, boxes, and/or crates sent "Freight On Board" (FOB) that require anyone, other than the delivery driver, to unload from the carrier. The Hotel will not be responsible for packages left at the Hotel.
Conduct: MSTC (Michigan Shoe Travelers Club) and the Michigan Shoe Market is committed to creating a workplace free of unlawful harassment. Liability / Property / Insurance: Each exhibitor agrees to hold harmless Michigan Shoe Travelers Club, Inc. / Embassy Suites Hotel Livonia/Art Craft Display, Inc from any and all liability that might ensure from any cause whatsoever, including accidents or injuries to exhibitors, their agents or employees. Exhibitors assume all responsibility for accident, injury or property damage to any person viewing his/her exhibit where such accident, injury or property damage is caused by negligence of exhibitor, his/her agent or employee. In the event that, because of war, fire, government regulation, public catastrophe, act of God or the public enemy or any other cause beyond the control of the association, the market or any part thereof is prevented from being held, is cancelled by MSTA , in its sole discretion shall determine and refund to the Exhibitor the proportionate share of the balance of aggregate exhibit fees received which remains after deducting expenses incurred by MSTA and reasonable compensation to the Association, but in no case shall the amount of refund to the Exhibitor exceed the amount of the exhibit paid. Exhibitor shall maintain such insurance as will fully protect Show management/Embassy Suites by Hilton Hotel Troy/Art Craft Display, Inc. from any and all claims of any nature, including claims under Workman’s Compensation Act, and claims for property damage and personal injury including death which may arise from the operations of exhibit in connection with his/her rental.
I voluntarily agree to assume all the risks and accept sole responsibility for any injury, illness, damage, or loss that I may experience or incur in connection with my attendance at the Michigan Shoe Market. I hereby release and covenant not to sue Michigan Shoe Travelers Club, Inc. its employees, agents and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Michigan Shoe Travelers Club, Inc., its employees, agents, and representatives. I agree to hold harmless the Michigan Shoe Travelers Club, Inc. for any and all liabilities that may be associated with the management, set up, accidents that may happen, or acts by other people at the event. I also agree not to enjoin the Michigan Shoe Travelers Club, Inc. in any lawsuit or action against any other entity associated with said event. I acknowledge the contagious nature of communicable illensses and voluntarily assume the risk that I may be exposed to or infected by the a communicable issness or disease by attending the event. Anyone who is experiencing a fever, is ill, or has symptoms of COVID-19 should not attend the Market. COVID-19 clause - I understand that by registering for and/or entering the Michigan Shoe Market I assume all risks related to exposure to comminicable illenss or disease at the Michigan Shoe Market.
UNDERSTANDING: By completing this application, I hereby agree to all the terms and conditions set out in this Contract/Agreement and in the rules and regulations, and confirm that I have read and understand all terms and conditions set out herein. Protocols will be updated and adjusted to local mandates.
Exhibit Room Exhibitors: Rooms will be assigned and Directory will be set up one month befor the Market. Late registrants will not be listed in the Directory, but rather in a supplement to the Directory. Check-in day is Saturday, predceding Market. Room Rate: $121 per day plus tax, with a three night (Saturday, Sunday, Monday) Room Assignments: All room assignments on all floors will be conducted on a lottery basis. (As always, we will continue to honor requests to place company representatives together in a block of rooms as part of our lottery drawing). Furniture: Your furniture will be adjusted to the Floor Room Layout Plan you select below. The display tables you order will be delivered to your room on Saturday set up day by 4 PM. The display tables are the only furniture you are permitted to move. The hotel will charge you $250 or an amount equal to damages if Hotel furniture (other than the display tables delivered to your room) is moved on your own. If any furniture needs to be moved, please contact the front desk for assistance. Cancellation Information: Once the Directory has gone to print, the exhibit fee will not be refunded. One month after registration deadline date is the cut-off date for any refund of exhibit fee. If you do not cancel your hotel room and do not show up, the hotel will bill you for your room as it is a guaranteed reservation. IF YOU CANCEL YOUR EXHIBIT ROOM LESS THAN ONE WEEK BEFORE THE MARKET YOU WILL BE BILLED FOR A MINIMUM OF ONE HOTEL ROOM NIGHT
Booth exhibitors are responsible for making their three night mandatory sleeping room Embassy Suites by Hilton Hotel Troy reservations. A reservation link will be sent to each exhibitor upon receipt of their registration. Booth Registration will be completed by the first incoming applications with all fees included and Hotel Reservation completed. Booth numbers will be assigned and the Directory set up shortly after the registration deadline date. Check-in is Saturday preceding the Market after 12 p.m. Breakdown of booths: After 5 on Monday of the Market. Late registrants will not be listed in the Directory. Once the Directory has gone to printer, the Exhibit Fee will be non-refundable. Booth space dimensions will be strictly enforced. All display items must be contained in the booth space purchased. Failure to abide by this rule will prohibit booth exhibitor from assignment of booth space at future markets. Booth spaces have always enjoyed high demand and we expect that trend to continue.
Lighting. We offer spot lights for rent. All spotlights now must be LED. If you bring your own spotlights, they must be LED. This will be strictly enforced. Booths must remain open until 5 PM on Monday. In an effort to preserve the integrity of the Market, any exhibitor found in violation of breaking down exhibit space early will be fined $150 and may be assigned at following Market less desirable exhibit space, including corner Hotel exhibit rooms (not located on main hallway).
All Exhibitors, both booth exhibitors and exhibit room exhibitors must have their display areas fully displayed and manned by an exhibitor until close of show at 5PM on final day of Market. Any exhibitors found to be closing up their exhibit areas prior to Market close will be fined $150 and risk future participaiton in the Michigan Shoe Market. If there is an emergency, please contact a MSTC Board Member or the MSTC Executive Director for permission to close prior to Market close.
All exhibitors in your booth must be registered as exhibitors or extra salesmen and agree to the terms and conditions of this contract/ agreement.
